President Luis Abinader has enacted the Law of the Appeal of Cassation

Santo Domingo, DR.- President Luis Abinader on Tuesday, January 17th, enacted Law Number 2-23, which regulates the procedure for appeal in matters of civil, commercial, labor, real estate, administrative and tax disputes. This is a law that applies to the entire national territory and will take effect after its publication, according to the legal deadlines established in the law, with the exceptions provided for in it regarding sentences handed down before its entry into force.

Appeal is a remedy that allows the Supreme Court of Justice to censor decisions that are not in conformity with the “rules of law” and is established in the Constitution of the Republic.

It was previously governed by Laws 3726 of 1953 and 491-08 of 2008, both of which were repealed by this new legal norm.

The initiative, which originated in the Senate of the Republic, designs a scheme of appeals in which the sentences that can be challenged are specific to certain matters, exceed a certain amount in their decision, or impact the figure of the appeal.

Among the novelties of the enacted law, stands out the provision of a procedure where the appeal process does not stop for the inactivity of the parties, thus eliminating incidents of exclusions and the expiration of the appeal, which avoids the issuance of administrative decisions.
